These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and EchoHost ("Company", “we”, “us”, or “our”), concerning your access to and use of the https://echohost.org website, as well as any other media form, media channel, mobile website, or application related, linked, or otherwise connected thereto (collectively, the “Site”).
By accessing the Site and/or using our hosting services, you confirm that you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE OR SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated into these Terms by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time. We will notify you of material changes by updating the “Last updated” date at the top of this page. You waive any right to receive individual notice of each change. You are responsible for reviewing the Terms regularly. Your continued use of the Site or Services after the revised Terms are posted constitutes your acceptance of the changes.
The information provided on the Site is not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such use would be contrary to law or regulation, or which would subject us to registration requirements in such jurisdiction. You access the Site from such locations at your own initiative and are solely responsible for compliance with local laws.
The Site and Services are not designed to comply with industry-specific regulations (e.g., HIPAA, FISMA, GLBA). If your use of our Services would be subject to such laws, you are not permitted to use this Site or any related services.
This Site is intended for users who are at least 13 years of age. If you are under the age of majority in your jurisdiction (typically under 18), you must have permission from and be directly supervised by a parent or guardian. If you are a minor, your parent or guardian must read and agree to these Terms on your behalf before you may use the Site or Services.
Unless otherwise indicated, the Site is the proprietary property of EchoHost and all source code, databases, functionality, software, website design, server configurations, scripts, support materials, audio, video, text, photographs, and graphics (collectively, the “Content”), as well as the trademarks, service marks, and logos (the “Marks”) displayed on the Site or within any part of the EchoHost infrastructure, are owned or licensed by us. These materials are protected by applicable copyright and trademark laws, as well as other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions.
The Content and Marks are provided "AS IS" for your informational and personal use only. Except as expressly permitted in these Terms, no part of the Site, Content, or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, reverse-engineered, or otherwise exploited for any commercial purpose whatsoever without our express prior written permission.
Provided you are eligible to use the Site, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and to download or print a copy of any portion of the Content to which you have lawfully gained access solely for your personal, non-commercial use.
We reserve all rights not expressly granted to you in and to the Site, the Content, and the Marks.
By using the Site or our services, you represent and warrant that:
All registration information you submit will be true, accurate, current, and complete;
You will maintain the accuracy of such information and promptly update it as needed;
You have the legal capacity to enter into this agreement and you agree to comply with these Terms of Service;
You are not under the age of 13;
If you are a minor in your jurisdiction, you have received parental or legal guardian consent to use the Site;
You will not access the Site or services through automated or non-human means (e.g., bots, scripts, or scrapers);
You will not use the Site or services for any unlawful or unauthorized purpose;
Your use of the Site and services does not violate any applicable law or regulation.
If any information you provide is untrue, inaccurate, not current, or incomplete, EchoHost reserves the right to suspend or terminate your account, refuse any and all current or future use of the Site or services (or any portion thereof), and take legal action where appropriate.
To access certain features of the Site or use our hosting services, you may be required to register an account. You agree to provide accurate, current, and complete registration information and to keep your login credentials confidential. You are solely responsible for all activities that occur under your account, whether authorized by you or not.
You must promptly notify us of any unauthorized access or use of your account or any other breach of security. EchoHost will not be liable for any loss or damage arising from your failure to comply with these responsibilities.
We reserve the right, in our sole discretion, to remove, reclaim, or change a username you select if we determine that such username is:
Inappropriate
Obscene
Misleading
Impersonating another individual or entity
Otherwise objectionable or prohibited
All products and services offered by EchoHost are subject to availability. We reserve the right to modify, suspend, or discontinue any product or service at any time, for any reason, without prior notice.
Prices for all products and services are subject to change without notice. EchoHost is not responsible for any discrepancies or errors in pricing and reserves the right to correct any errors or inaccuracies.
We accept the following forms of payment:

You agree to provide current, complete, and accurate purchase and account information for all purchases made through the Site. You further agree to promptly update your account and payment information, including email address, payment method, and payment card expiration date, to ensure successful transaction processing and timely communication.
All prices are listed in U.S. dollars (USD) unless otherwise specified. Sales tax will be added to the purchase price as required by applicable law. We reserve the right to change prices at any time without prior notice.
By placing an order, you agree to pay all charges at the prices then in effect, including any applicable fees. You authorize us to charge your selected payment provider for the full amount of your order at the time of purchase.
EchoHost reserves the right to correct any pricing errors or mistakes, even if payment has already been requested or received.
We may refuse or cancel any order, in whole or in part, at our sole discretion. We also reserve the right to limit quantities per person, household, or order, including orders placed under the same account, payment method, or billing/shipping address. Orders that we reasonably believe are placed by dealers, resellers, or distributors may be limited or prohibited.
t EchoHost, we strive to provide high-quality server hosting services. Due to the nature of digital services and resource allocation, refunds are only available within 24 hours of your initial purchase.
To be eligible for a refund:
You must request the refund within 24 hours of your first payment.
The service must not have been actively used, customized, or had any significant data uploaded..
Refund requests made after the 24-hour window will not be accepted.
Refunds will not be provided for:
Renewals or recurring payments
Downtime or service interruptions
Abuse or violation of our Terms of Service
Change of mind or buyer’s remorse

EchoHost reserves the right to deny refund requests that do not comply with these terms.
You may only use the Site and Services for the purposes for which we make them available. Any other use, especially commercial endeavors not explicitly authorized by EchoHost, is prohibited.
As a user of EchoHost, you agree not to engage in any of the following activities:
Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without our prior written permission.
Trick, defraud, or mislead EchoHost or other users, especially in attempts to gain sensitive account information such as passwords.
Circumvent, disable, or interfere with security-related features of the Site, including those preventing copying or restricting use of Content.
Disparage, tarnish, or harm EchoHost, the Site, or our reputation.
Use any information from the Site to harass, abuse, or harm others.
Abuse our support services or submit false abuse or misconduct reports.
Use the Site inconsistently with applicable laws or regulations.
Engage in unauthorized framing or linking to the Site.
Upload or transmit viruses, Trojan horses, malware, or any material that disrupts or impairs the Site or others’ use of it, including excessive capitalization and spamming.
Use automated systems (e.g., bots, scripts, scrapers, data mining tools) to access or interact with the Site.
Remove or alter copyright or proprietary notices from any Content.
Impersonate any person or user or use another user’s username without authorization.
Upload or transmit passive or active tracking mechanisms such as web bugs, 1x1 pixels, or spyware.
Interfere with, disrupt, or overload the Site or its networks and services.
Harass, intimidate, or threaten our employees, agents, or contractors.
Attempt to bypass any access restrictions or security measures.
Copy, adapt, reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software or technology used in the Site, except as permitted by law.
Use unauthorized automated tools including spiders, robots, cheat utilities, scrapers, or offline readers beyond standard browser or search engine activity.
Use purchasing agents or automated methods to make purchases on the Site without permission.
Collect usernames, email addresses, or other user data by electronic or other means for sending unsolicited communications or creating fake accounts.
Use the Site or Content to compete with EchoHost or for any revenue-generating commercial enterprise not expressly authorized.
Violation of any of these prohibited activities may result in immediate suspension or termination of your account and access to services, as well as potential legal action.
While EchoHost’s Site does not generally allow users to submit or post content, we may provide opportunities for you to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Site (collectively, “Contributions”). Contributions may include, but are not limited to, text, writings, videos, audio, photographs, graphics, comments, suggestions, personal information, or other materials.
Contributions may be viewable by other users of the Site or through third-party websites, and as such, may be subject to the Site’s Privacy Policy.
By creating or making available any Contributions, you represent and warrant that:
You are the sole creator and owner of the Contributions or have all necessary licenses, rights, consents, releases, and permissions to authorize EchoHost, the Site, and other users to use your Contributions in any manner consistent with these Terms.
The creation, distribution, transmission, public display, performance, access, downloading, or copying of your Contributions does not infringe upon or violate any proprietary rights (including copyright, patent, trademark, trade secret, or moral rights) of any third party.
You have obtained written consent from all identifiable individuals featured or referenced in your Contributions, permitting EchoHost to use their name or likeness.
Your Contributions are truthful and not false, inaccurate, or misleading.
Your Contributions are not unsolicited or unauthorized advertising, promotional materials, spam, pyramid schemes, chain letters, or other forms of solicitation.
Your Contributions are not obscene, offensive, violent, harassing, defamatory, or otherwise objectionable, as determined by EchoHost in its sole discretion.
Your Contributions do not ridicule, disparage, intimidate, or abuse any individual or group.
Your Contributions do not promote harassment, threats, or violence against any person or group.
Your Contributions comply with all applicable laws, regulations, and rules.
Your Contributions respect the privacy and publicity rights of others and do not contain child pornography or any material harmful to minors.
Your Contributions do not include offensive comments related to race, national origin, gender, sexual orientation, or physical disability.
Your Contributions do not violate or link to material that violates these Terms or any applicable laws.
Any violation of the above may result in the removal of your Contributions and suspension or termination of your rights to use the Site and its services.
By submitting any information, personal data, suggestions, or other feedback (“Contributions”) to EchoHost through the Site or related services, you grant us the right to access, store, process, and use such Contributions in accordance with our Privacy Policy and your privacy settings.
You further agree that we may use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such feedback or suggestions for any purpose, without compensation or attribution to you.
EchoHost does not claim ownership over your Contributions. You retain all intellectual property rights and proprietary interests in your Contributions.
However, you acknowledge and agree that:
You are solely responsible for the content of your Contributions.
EchoHost is not liable for any statements, representations, or omissions contained in your Contributions.
You agree to indemnify, defend, and hold harmless EchoHost and its affiliates from any claims, damages, liabilities, or expenses arising out of or related to your Contributions.
You waive any right to assert any claim against EchoHost regarding your Contributions.
As part of the Site’s functionality, you may link your EchoHost account with third-party service providers’ accounts (each a “Third-Party Account”) by:
Providing your Third-Party Account login information through the Site; or
Authorizing EchoHost to access your Third-Party Account as permitted by the terms governing that account.
By linking your Third-Party Account, you represent and warrant that:
You have the right to disclose your login information or grant access without violating the terms of that Third-Party Account;
Your authorization does not obligate EchoHost to pay fees or subject us to restrictions imposed by the third-party provider.
When linked, EchoHost may access, store, and make available content you have provided or stored in your Third-Party Account (the “Social Network Content”) through the Site, including friend lists and other related information. We may also submit and receive additional information from your Third-Party Account as notified during the linking process.
Please note:
Personally identifiable information posted to your Third-Party Accounts may be visible through your EchoHost account, subject to your privacy settings on those platforms.
If the Third-Party Account or associated service becomes unavailable or access is terminated by the provider, related Social Network Content may no longer be accessible through the Site.
You may disconnect your Third-Party Account at any time via your account settings or by contacting EchoHost support.
Your relationship with any third-party service provider is governed solely by your agreement with that provider. EchoHost does not review or endorse any Social Network Content and is not responsible for its accuracy, legality, or non-infringement.
Additionally, with your permission, we may access your email address book or contacts list to identify and notify you of contacts who also use EchoHost. You may revoke this access at any time.
Upon disconnection of a Third-Party Account, we will attempt to delete any stored information obtained through that account, except for your username and profile picture associated with your EchoHost account.
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site or EchoHost’s services (collectively, “Submissions”) that you provide to us are non-confidential and shall become the sole property of EchoHost.
EchoHost shall own all exclusive rights, including all intellectual property rights, to these Submissions and may use, reproduce, modify, distribute, and otherwise exploit them for any lawful purpose, whether commercial or otherwise, without any obligation to acknowledge or compensate you.
You hereby waive any moral rights or similar rights you may have in your Submissions.
You represent and warrant that your Submissions are either your original work or that you have obtained all necessary rights and permissions to provide them to us.
You agree that you will not pursue any claims against EchoHost for alleged or actual infringement or misappropriation of any proprietary rights in your Submissions.
EchoHost reserves the right, but is not obligated, to:
Monitor the Site for any violations of these Terms of Service;
Take appropriate legal action against anyone who, at our sole discretion, violates applicable laws or these Terms, including reporting such users to law enforcement authorities;
Refuse, restrict access to, limit the availability of, or disable (where technologically feasible) any of your Contributions or any portion thereof;
Remove or disable any files or content that are excessive in size or otherwise burdensome to our systems, without prior notice or liability;
Manage the Site in any manner we deem necessary to protect our rights and property and to ensure the proper functioning of the Site and our services.
We take data privacy and security seriously. Please review our Privacy Policy, which is incorporated into these Terms of Service by reference. By using the Site or our services, you agree to be bound by our Privacy Policy.
Please be advised that the Site and our services are hosted in Germany. If you access the Site or services from other regions with different laws governing data collection, use, or disclosure, by continuing to use our services, you consent to the transfer and processing of your personal data in Germany.
Furthermore, we do not knowingly collect personal information from children under the age of 13, nor do we market to children. In compliance with the U.S. Children’s Online Privacy Protection Act (COPPA), if we become aware that a child under 13 has provided us with personal information without verifiable parental consent, we will delete such information as soon as reasonably practicable.
These Terms of Use remain in full effect for as long as you use the Site and our services.
Without limiting any other provision of these Terms, EchoHost reserves the right, at our sole discretion and without prior notice or liability, to:
Deny access to and use of the Site and services (including blocking IP addresses) to any person, for any reason or no reason, including but not limited to breach of these Terms or any applicable law;
Terminate your use or participation in the Site and services at any time;
Delete your account and any content or information you have posted on the Site.
If your account is terminated or suspended, you are prohibited from registering a new account using your own name, a fake or borrowed name, or the name of any third party, even if you are acting on behalf of that third party.
In addition to termination or suspension, EchoHost reserves the right to pursue any appropriate legal action, including civil, criminal, and injunctive remedies.
EchoHost reserves the right, at our sole discretion and without prior notice, to change, modify, or remove any content on the Site at any time for any reason. We are not obligated to update any information on the Site.
We also reserve the right to modify, suspend, or discontinue all or any part of our services or offerings without notice. We will not be liable to you or any third party for any changes, price adjustments, suspensions, or discontinuations.
While we strive to keep the Site and services available at all times, we cannot guarantee uninterrupted access. Hardware, software, or other issues may cause temporary interruptions, delays, or errors. Maintenance or upgrades may also require downtime.
You agree that EchoHost will not be held liable for any loss, damage, or inconvenience caused by your inability to access or use the Site or services during any such downtime or interruptions.
Nothing in these Terms obligates EchoHost to maintain, support, or provide updates, corrections, or releases for the Site or services.
These Terms of Use shall be governed by and construed in accordance with the laws of Germany, excluding its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
If you are a consumer residing in the European Union, you also retain the protections afforded by mandatory provisions of the law in your country of residence.
Both you and EchoHost agree to submit to the non-exclusive jurisdiction of the courts located in Berlin, Germany. This means you may bring claims regarding these Terms of Use either in Germany or in the EU country where you reside to protect your consumer rights.

The Site may contain typographical errors, inaccuracies, or omissions relating to our services, including descriptions, pricing, availability, and other information. EchoHost reserves the right to correct any such errors, inaccuracies, or omissions and to update or change the information on the Site at any time without prior notice.
The Site and Services are provided on an “AS IS” and “AS AVAILABLE” basis. Your use of the Site and Services is at your sole risk.
To the fullest extent permitted by law, EchoHost disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We make no representations or warranties regarding the accuracy, completeness, or reliability of the Site’s content or the content of any third-party websites linked to the Site.
EchoHost assumes no liability or responsibility for:
Errors, mistakes, or inaccuracies in content or materials;
Any personal injury or property damage of any nature resulting from your use of the Site;
Unauthorized access to or use of our secure servers or any personal or financial information stored therein;
Interruptions or cessation of transmission to or from the Site;
Any viruses, Trojan horses, or similar harmful components transmitted through the Site by any third party;
Any errors or omissions in content or materials, or for any loss or damage incurred as a result of using such content.
We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Site, any linked website, or any site featured in advertising banners.
EchoHost is not a party to, and will not monitor, any transactions between you and third-party providers. When purchasing products or services through any platform, you should exercise your best judgment and caution.
To the fullest extent permitted by law, in no event will EchoHost, its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages. This includes, but is not limited to, lost profits, lost revenue, loss of data, or any other damages arising from your use of the Site or services, even if we have been advised of the possibility of such damages.
You agree to defend, indemnify, and hold harmless EchoHost, its subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees from and against any and all losses, damages, liabilities, claims, demands, costs, and expenses (including reasonable attorneys’ fees and costs) arising out of or related to:
Your use of the Site or services;
Your breach of these Terms of Use;
Any breach of your representations or warranties contained herein;
Your violation of any rights of a third party, including intellectual property rights; or
Any harmful or unlawful acts you commit against other users with whom you interact through the Site.
We reserve the right, at our sole discretion and at your expense, to assume the exclusive defense and control of any claim subject to indemnification by you. You agree to cooperate fully with our defense of such claims at your expense.
We will use reasonable efforts to notify you promptly upon becoming aware of any claim, action, or proceeding subject to this indemnification.
EchoHost will maintain certain data you transmit to the Site to manage and improve Site performance, as well as data related to your use of the Site.
While we perform routine backups, you are solely responsible for all data you transmit or that relates to your activities on the Site.
You agree that EchoHost will not be liable for any loss, corruption, or damage to your data, and you waive any right to bring claims against us arising from such loss or corruption.
By visiting the Site, sending emails to EchoHost, or completing online forms, you consent to receive electronic communications from us.
You agree that all agreements, notices, disclosures, and other communications provided electronically via email or on the Site satisfy any legal requirement that such communications be in writing.
You hereby agree to the use of electronic signatures, contracts, orders, and other records, as well as electronic delivery of notices, policies, and transaction records initiated or completed by EchoHost or via the Site.
You waive any rights under any laws or regulations that require an original signature, delivery or retention of paper records, or payment and granting of credits by means other than electronic methods.

These Terms of Use, along with any policies or operating rules posted by EchoHost on the Site, constitute the entire agreement between you and us regarding your use of the Site and services.
Our failure to enforce any right or provision in these Terms shall not be considered a waiver of that right or provision.
These Terms will be enforced to the fullest extent permitted by applicable law.
EchoHost may assign or transfer any of its rights or obligations under these Terms at any time without notice.
We shall not be liable for any loss, damage, delay, or failure to act resulting from causes beyond our reasonable control.
If any provision or part of a provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed without affecting the validity and enforceability of the remaining provisions.
Nothing in these Terms creates any joint venture, partnership, employment, or agency relationship between you and EchoHost.
These Terms will not be construed against EchoHost simply because we drafted them.
You waive any defenses related to the electronic format of these Terms or the lack of a physical signature by either party.
